What documents require a notary visit?
The procedure for preparing documents outside the office has the same legal force as a personal visit to the notary’s office. Most often, a notary visit is required for the following actions:
- Preparation of a notarial will: when the testator wishes to dispose of property but cannot leave home or is undergoing medical treatment.
- General or special power of attorney: transfer of authority to relatives for managing a bank account, selling real estate, or representation before government institutions.
- Medical power of attorney and living will: instructions regarding future medical care.
- Signature certification: on declarations or affidavits for court, the Ministry of Interior (Misrad HaPnim), or foreign consulates.
Visit to a hospital or bedridden patient: a strict legal requirement
This is the most important detail to know in advance. According to the rules of the Israeli Ministry of Justice (Misrad HaMishpatim), if a person is hospitalized or bedridden at home, the notary is not allowed to certify their signature or will without a special medical certificate — in Hebrew, “teudat rofe” or “ishur refui.”
Requirements for the medical certificate:
- It must clearly confirm that the patient is of sound mind, understands their actions, and is capable of making decisions — “tzalul be-daato.”
- The certificate must be issued strictly on the day of signing the notarial document. A certificate from the previous day will not be accepted.
If a notary certifies a bedridden patient’s will or power of attorney without this certificate, the document can easily be challenged and annulled in court.
How to prepare for the notary’s arrival
To ensure that the procedure goes smoothly and without delays, it is important to prepare the following in advance:
- Identity documents: a valid Teudat Zehut or foreign passport (Darkon) of the person whose signature is being certified. A driver’s license is not suitable for notarial acts.
- Draft document: discuss the matter with our office in advance. We will prepare the text of the power of attorney, declaration, or will so that, on site, it only needs to be read aloud and signed.
- Arranging witnesses: in some cases, for example, for specific types of wills or for people with hearing or vision limitations, independent witnesses may be required. We discuss this issue during the planning stage of the visit.
How much does a notary visit cost?
The cost of all notarial services in Israel is strictly fixed by the Ministry of Justice rates, which are updated annually.
The cost of a visit consists of two parts:
- The basic fee for the notarial act itself, such as signature certification or preparation of a will.
- An additional fee for the visit, which depends on the time spent by the notary traveling there and back, as well as transportation expenses.
